1. Acceptance of Terms
These Terms & Conditions govern your use of the website and services provided by Baseline Performance Strength & Conditioning ("Baseline Performance", "we", "our" or "us").
By accessing the Baseline Performance website, purchasing a service, or participating in any coaching program, you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions.
If you are under 18 years of age, these Terms & Conditions must be accepted by a parent or legal guardian.
2. About Baseline Performance
Baseline Performance provides:

Individualised strength and conditioning programs

Online coaching
-
Performance assessments
-
Movement screening
-
Athlete education
-
Return to performance programming
-
In-person coaching services where available
Baseline Performance does not provide medical diagnosis or treatment.
3. Eligibility
Participants must:
-
provide accurate personal and health information;
-
follow coaching instructions to the best of their ability;
-
notify Baseline Performance of any injury, illness or medical condition that may affect participation.
Parents or guardians are responsible for providing accurate information for athletes under 18 years of age.
4. Payments
All prices are displayed in Australian Dollars (AUD).
Payments are processed securely through Stripe.
Subscriptions will be charged according to the selected membership plan.
Failure to maintain payment may result in suspension of coaching services until payment is received.
5. Memberships
Memberships continue until cancelled.
Cancellation requests must be submitted before the next billing date.
No partial refunds are provided for unused portions of a billing period unless required by Australian Consumer Law.
Baseline Performance reserves the right to modify membership inclusions and pricing with reasonable notice.
6. Coaching Services
Baseline Performance will use reasonable skill and care when providing coaching services.
Athletes acknowledge that:

results vary between individuals;

progress depends on many factors outside our control;

no guarantee of specific performance improvements can be made.
7. Athlete Responsibilities
Participants agree to:
-
complete exercises safely;
-
follow prescribed programs appropriately;
-
communicate injuries or concerns promptly;
-
complete assessments honestly;
-
use equipment safely;
-
maintain appropriate supervision where required.
Parents remain responsible for supervising younger athletes when training at home.
8. Health & Medical Responsibility
Participants confirm they are medically fit to participate or have obtained appropriate medical clearance where necessary.
Baseline Performance is not responsible for determining whether participation is medically appropriate.
If pain, dizziness, illness or unusual symptoms occur, exercise should cease immediately and medical advice should be sought where appropriate.
9. Online Coaching
Online coaching is provided using information supplied by the athlete.
Athletes acknowledge that remote coaching has limitations and that exercise technique cannot always be monitored continuously.
Baseline Performance may request additional videos or assessments where necessary.
10. Performance Assessments
Assessment results provide information about current physical performance and movement quality.
Assessments do not constitute medical examinations or injury diagnoses.
Recommendations are based on the information available at the time of assessment.
11. Intellectual Property
All content produced by Baseline Performance remains the intellectual property of Baseline Performance unless otherwise stated.
This includes:

training programs;

videos;
-
exercise libraries;
-
educational resources;
-
assessment reports;
-
graphics;
-
logos;
-
written content.
Materials may not be copied, reproduced, distributed or sold without written permission.
12. Website Use
Users agree not to:

misuse the website;
-
interfere with website security;
-
upload malicious software;
-
attempt unauthorised access;
-
reproduce website content without permission.
13. Third-Party Services
Baseline Performance uses trusted third-party providers including:

Wix
-
Stripe
-
TeamBuildr
-
Google services
We are not responsible for interruptions, outages or policies relating to third-party platforms.
14. Limitation of Liability
To the maximum extent permitted by law, Baseline Performance excludes liability for any direct, indirect, incidental or consequential loss arising from:

participation in training;
-
use of our website;
-
reliance on educational material;
-
equipment failure;
-
third-party services.
Nothing in these Terms excludes rights that cannot legally be excluded under Australian Consumer Law.
15. Australian Consumer Law
Nothing in these Terms & Conditions limits or excludes any rights or guarantees available under the Competition and Consumer Act 2010 (Cth) or Australian Consumer Law.
Where permitted by law, our liability is limited to resupplying the relevant service.
16. Suspension or Termination
Baseline Performance reserves the right to suspend or terminate services where:

these Terms are breached;

abusive or inappropriate behaviour occurs;

payment obligations are not met;

participation presents an unreasonable safety risk.

Personal information is handled in accordance with our Privacy Policy.
By using our services you consent to the collection and use of personal information as described in that policy.
18. Changes to These Terms
Baseline Performance may update these Terms & Conditions from time to time.
The most current version will always be published on our website.
Continued use of our services constitutes acceptance of any updated Terms.
19. Governing Law
These Terms & Conditions are governed by the laws of Victoria, Australia.
Any disputes will be subject to the jurisdiction of the courts of Victoria.
